General Terms and Conditions

Mallorca Marketing Team S.L.

1. Scope of Agreement

Mallorca Marketing Team S.L. provides marketing, consulting, and advertising services – including Addressable TV – exclusively to businesses and self-employed professionals with a registered commercial activity. All agreements concluded are business-to-business (B2B) service contracts.

2. Legal Nature of the Contract

Contracts concluded with Mallorca Marketing Team S.L. are considered service contracts under Article 1255 of the Spanish Civil Code. It is explicitly stated that these are not consumer contracts, and therefore the right of withdrawal under the Spanish General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007) does not apply.

3. Payment Terms

The payment terms are defined in the respective offer or invoice. Unless otherwise agreed in writing, payment must be made in advance or within the agreed deadline. In case of late payment, interest on arrears will be charged in accordance with Law 3/2004 on combating late payment in commercial transactions.

4. Client Obligations

The client agrees to provide all information and materials required for the proper execution of the services. Any delay in providing this information may affect delivery times and does not constitute a breach on the part of Mallorca Marketing Team S.L.

5. Liability

Mallorca Marketing Team S.L. is not liable for the financial results arising from the use of the campaigns or materials provided, nor for any business decisions made by the client based on the delivered services.

6. Data Protection

Both parties agree to comply with the General Data Protection Regulation (GDPR) and applicable Spanish data protection laws.

7. Governing Law and Jurisdiction

These terms are governed by Spanish law. For the resolution of any disputes arising from the contract, the parties expressly submit to the courts of Palma de Mallorca, waiving any other jurisdiction that may otherwise apply.

8. Amendments

Mallorca Marketing Team S.L. reserves the right to amend these General Terms and Conditions upon prior notice to the client. The version in effect at the time of contract conclusion or explicitly communicated to the client shall apply.
